Purchase & Booking Policy

 


By making a purchase or booking through this application, the client (“the Client”) acknowledges having read, understood, and accepted the present Purchase & Booking Policy in full.


 

1. Nature of Services

 


All purchases made through this platform relate to access to clubhouse facilities, memberships, rentals of spaces, or related services. The availability of facilities is subject to operational constraints, safety requirements, and prior bookings.


 

2. Booking Confirmation and Payments

 


A booking is considered confirmed only once the required payment has been received and recorded by the Clubhouse.

Unless otherwise stated in writing:

 

  • A deposit may be required to secure a booking.

  • The balance must be paid within the timelines communicated at the time of booking.

    Failure to complete payment within the required timeframe may result in automatic cancellation without refund.

 


 

3. No Right of Refund

 


All purchases are final and non-refundable, including but not limited to:

 

  • Membership fees 

  • Facility rentals

  • Event bookings

  • Deposits and partial payments

 


No refunds will be issued in case of cancellation, no-show, late arrival, or early departure, regardless of the reason, except where expressly required by applicable law. Services can't be transferred or postponed without prior written notice. 


 

4. Cancellations and Modifications

 


Any request for cancellation or modification must be submitted in writing.

The Clubhouse reserves the right to accept or refuse such requests at its sole discretion. Acceptance of a modification does not create an obligation to issue any refund or credit.


 

5. Use of Facilities and Conduct

 


The Client agrees to use the facilities responsibly and in compliance with:

 

  • Clubhouse rules and regulations

  • Safety instructions

  • Local laws and regulations

 


The Clubhouse reserves the right to deny access or terminate use without refund in case of inappropriate behavior, non-compliance, or actions that may cause damage, disturbance, or risk to persons or property.


 

6. Limitation of Liability

 


To the fullest extent permitted by law, the Clubhouse, its owners, directors, employees, and partners shall not be held liable for:

 

  • Personal injury, loss, or damage to personal property

  • Delays, cancellations, or service interruptions

  • Indirect, incidental, or consequential damages

 


The Client uses the facilities at their own risk.


 

7. Force Majeure

 


The Clubhouse shall not be held responsible for failure to perform its obligations due to events beyond its reasonable control, including but not limited to force majeure, government restrictions, power outages, security issues, or natural events. No refunds or compensation shall be due in such cases.


 

8. Dispute Resolution

 


Any dispute arising from a purchase or booking shall be handled in good faith through amicable discussion.

In the absence of an amicable resolution, disputes shall fall under the exclusive jurisdiction of the competent courts of the Democratic Republic of Congo, unless otherwise required by mandatory law.


 

9. Acceptance of Policy

 


By proceeding with a purchase or booking, the Client expressly waives any claim, action, or formal proceeding against the Clubhouse relating to the purchase, booking, or use of facilities, except in cases of gross negligence or willful misconduct as defined by law.
